What was the aftermath and full story?

This video's 5 years old, the backstory is that the guy in the car owns a landscaping company who did work for the guy by the white truck near the end, they ended up damaging a gas line while working and the homeowner claimed that them hitting the gas line caused some concrete work he was having done to not set properly, so the landscape company decided to be nice and pay for half of the damages but the owner ended up pocketing the money instead and never had any work done to repair the supposed damage. This video was taken after someone who works for the landscaping company was sent over to talk about this money issue was told to leave, the guy breaking the windows was the homeowner's father in law who didn't serve anytime in jail for this and was let go on a mischief charge.

How do you threaten someone with a weapon, break two car windows, and threaten more harm to get a mischief charge.

"Oh boy, im going to cause so much mischief today by threatening peoples lives"

Last time someone was going around and smashing people's car windows in my neighborhood, someone opened fire on them with a shotgun. Nothing happened to them either.

Well, it is criminal mischief.

§ 11.410 Criminal mischief.(a) A person is guilty of criminal mischief if he or she:(1) Damagestangible property of another purposely, recklessly, or by negligence inthe employment of fire, explosives, or other dangerous means; or(2) Purposely or recklessly tampers with tangible property of another so as to endanger person or property; or(3) Purposely or recklessly causes another to suffer pecuniary loss by deception or threat.(b) Criminalmischief is a misdemeanor if the actor purposely causes pecuniary lossin excess of $100, or a petty misdemeanor if he or she purposely orrecklessly causes pecuniary loss in excess of $25. Otherwise, criminalmischief is a violation.

I would add an assault charge. As I understand it, Assault just requires a show of Capability and Intent to commit battery.

191

u/Dismal-Ebb-6411 13d ago

Also everyone here doesn't seem to understand the difference between criminal and civil action.

He was actually found guilty of criminal mischief, even if he did no jail time. That means he will automatically lose in a follow up civil suit for damages he caused by his criminal actions.

Dude is probably an ex cop.

1.3k

u/Biosterous 13d ago Gold

That was my first assumption as well. Extendible baton, the confidence of "I'm not going to jail", and the completely uncalled for escalation of a situation to violence. Man has former cop written all over him.

Knowing he got no jail time and only a mischief charge further cements that theory for me

149

u/Unbentmars 12d ago

A cop in my community earlier this year was smoking a cigar at the pool (which is against the rules of the pool and community) and when the community admins told him to stop he got very aggressive with them, demanded to know what they’d do if he refused to stop and if they’d call the cops on him.

Fuck cops who think they are above the law

I hate to say it but being old and white probably didn't hurt. Probably hired a decent attorney thanks to money as well.

326

u/PaanuriEater 13d ago

Don't even need a decent attorney, just stack the jury with elderly folks. I was on a jury as one of two young people. Pretty open and shut case of an old guy going nuts and slicing another guy's hand open over a backpack that didn't exist. Everyone's testimony except the attacker's lined up, all the evidence agreed, but all the old women on the jury were insistent that he is such a nice old man who reminds them of their fathers and therefore should be let off with just a warning.

It took hours of arguing to get a guilty verdict, even with a very minor punishment at least now the guy will be able to sue and have a good chance of winning.

That was step 1 to me losing all faith in our justice system. Steps 2 through infinity were learning what cops actually do with their time.

u/[deleted] 13d ago edited 13d ago

62

u/BalrogPoop 13d ago

Personally I think jury trials are a crock of shit. If rather be tried by a judge like in the French systems who actually understands the law, and the goal is to find the truth of what happened. Not assign blame based the biases of jurors.

At least it's easier to claim a single judge is biased based on his track record, than a whole jury, if there does happen to be a mistrial.

27

u/BigIntoScience 12d ago

Judges give out different verdicts based on if they've had lunch yet. Humans are wildly unreliable. I think part of the idea is that it's harder for all 12 people to be corrupt/generally shitty than for just the judge to have something going on.

Part of the job of all court employees involved is to make sure everyone understands the law. If someone doesn't do that, there's an issue.

The lesson?

Don’t pay damages to be ‘nice’ especially without any contract for what the money is to be used for. The compensation suggests liability. They very well may have not had any reason to be there anymore, the old man just proved to be even dumber...

92

u/ONLY_COMMENTS_ON_GW 13d ago

In my mind the landscaping company paid the dude off to not take them to court, what the owner does with that money is sort of their business, so no reason to go back, but obviously that old dude is bat shit bonkers lol

30

u/nyxo1 12d ago

Definitely. It's equivalent to my insurance company sending someone to my house to ask for money because I never actually replaced my bumper after a small fender bender.

The landscaping company willing paid them without a court order or contract. What they do with it after that point is none of your business.

Moments later, Tissington smashes two side windows before Dallyn drives away.

In a written post, Dallyn said he was there to have a "civil conversation" with the man's stepson, Tyler Stojan.

Dallyn said Stojan took money for some concrete work that was not completed.

"I stopped by to ask what he had done with said money, and if he was going to fix anything," wrote Dallyn.

But in a Facebook post, Stojan said Dallyn showed up twice on the day of the incident, demanding payment and making threats.

"I informed him that I owe him nothing, and would be paying him nothing, and to get off my property and not to come back," wrote Stojan. "We were very concerned about his attentions and whether he was armed. Our two small children were in the house."

Stojan said his stepfather waited for the RCMP after the incident, co-operated fully and has been charged.

Yeah in PA they made the stand your ground law apply to your vehicle now and not just your house. Thats exactly why I don't do road rage here because there is a pretty decent chance you pull this shit in PA and you're gonna end up dead, with the person shooting you not even spending a little bit of time in jail because you threatened them and they were justified in killing you

89

u/sandyclaus30 13d ago

I live in PA and didn’t even know we had the stand your ground law. I’m not worried because I don’t plan on doing any home invasion or road rage! My brother on the other hand is a Vietnam Vet and does not do well if someone rear ends him or does any minor damage to his vehicles. I’d better let him know!

75

u/Buc4415 13d ago

It’s not really stand your ground. It’s castle doctrine. All it does is reclassify your car as your castle along with your house.

57

It’s castle doctrine, you still have a duty to retreat in PA, but not from your home or your vehicle, the argument is that you cannot retreat from your home and you often cannot retreat in a vehicle without breaking other laws or endangering other lives.

Yeah, for real though. This video is clearly not from where I live.

Where I live, the driver was well within his rights of using lethal force to protect himself and his property. In my area, everyone I know is carrying a gun, and they're are all looking for a reason to use it.

The Sheriff would've laughed at the old man's corpse after watching the video evidence, then waved bye to the driver telling him to carryon and have a good day.

Before anyone complains that it's not necessary to carry a gun because that's law enforcement's job, then you've never lived 30-45 minutes away from the nearest peace officer in your area. There are parts of the US where people are left to police themselves because the population is too low to warrant a large law enforcement department.

EDIT: Thanks for the award!

214

u/DadJokeBadJoke 13d ago

When seconds count, police are only minutes away...

65

u/Splattershits 13d ago

They're only coming to clean up the mess

35

u/DadJokeBadJoke 13d ago

Only if they're not "too busy"...

39

u/SatanMeekAndMild 13d ago edited 12d ago

Seriously. My perspective of the police completely changed when I really needed them a couple times, and when they would finally show up, they scoffed at the idea of having to do their jobs, and decided it would be easier to do nothing.

They almost let fraudsters who claimed to be the new owners of my building rekey all of my locks. Presumably because of my physical appearance, they "didn't have time to really all this fucking paperwork" from my lawyer that said they were not the rightful owners. They said this while looking at a stack of bullshit paperwork that the other people gave them.

I had to leave and get my mid 30s masculine male neighbor to give them the exact same paperwork before they finally decided that it wasn't their job to tell anyone they couldn't enter a building.

Fuck you Chicago Police.

[/rant]

14

u/gentleman__ninja 12d ago

In the US the supreme court has explicitly decided that police have no obligation to protect people, enforce laws, or even respond to calls. Legally the police can entirely decide which parts of their job to actually do. Also with qualified immunity, they can do a lot of illegal stuff on duty and they usually won't get in trouble as long as they have some justification that is not verifiably false.

23

u/socialpresence 13d ago

No, no, they're coming to document the mess. The coroner takes the heaviest part of the mess. The fire department sprays away the liquid.

5

u/icenoid 12d ago

That’s attempted murder with a deadly weapon in some states. Like dude you can get deadly weapon charges so easy without even having to pack an expanding baton. Fun fact, expandable batons fit under the same category as firearms in requiring a CCL to carry. So using it in the commision of a crime means he threatened someone with a deadly weapon, same as if he had a knife or gun. Those things break bones pretty easily, they are way more devastating than their size implies. I hit my own shin with one by accident once and thought for sure I broke it but I was lucky.

From 2016:

A violent roadside confrontation, captured on dramatic video, has led to mischief charges. Grande Prairie RCMP confirmed they have charged a 67-year-old man. Damian Dallyn recorded and posted the video on YouTube. In the video, a man who identifies himself as Dennis Tissington walks over to Dallyn's parked car with a baton and taps on the window. "Aren't you in enough trouble?" Tissington asks. "No," Dallyn responds. "Why?" "You're gonna be," said Tissington. "You're gonna be in the (expletive) hospital if you don't get out of here." "No, you can't bring a weapon out on me," said Dallyn. "Yes I can, 'cause I have one." Moments later, Tissington smashes two side windows before Dallyn drives away.

316

u/phillyphreakphlippin 13d ago

There has to be an app for that by now, right? Too many situations where you want to record and report but can’t. That seems wrong especially in this situation and more.

199

u/CrumpledForeskin 13d ago

Pretty sure there’s an app that films to a cloud and calls police. I feel like I saw that somewhere.

Lemme look.

Edit: so there’s a few. A quick google search shows that you can download some apps that film to a cloud but it doesn’t look like you can call on your phone as well as film.

Not an app developer but seems like an opportunity to me.

You would not believe the number of guys like this who think they're Judge Dredd after they retire.

You have to have a camera pulled up any time you see an old fart with anger management issues and a micropenis stomp up to your car.

I had a situation where an older man brake checked me and got out to talk to me because of my loud car. I just stared at him winked and licked my lips, needless to say it was a terrible mistake and I made the situation much larger than it needed to be

55

u/e0f 13d ago

bruh don't leave us hanging

98

u/jackherselman 13d ago

Dude ended up freaking out and spitting a huge snotball onto my window, which is when I got out. Argument basically went “go back to surrey (city nearby that is stereotypically immigrants)” which I proceeded to kinda size up the dude to his face. Right after this he tried to get me to fight him in a parking lot but f that, it’s a lose lose situation. Not a chance I’m gonna be the guy who lost to an old man, or worse beat up an old man

Edit: the person behind me called the police and he apparently has done this before, and has a criminal mischief related charge already

71

u/DribsFlantoosey 13d ago

I was attacked by an old man. Pushed him away numerous times, even stopped him from falling after a push. He came back swinging each time. Finally landed one on my face. So, I clocked him. Broke his nose and sent him to the hospital. He called the cops.

Neighbors actually came and thanked me. Said he's a bully who used to beat people up and forgot his age. He lives two doors down and has sworn to kill me on sight.

I don't really feel bad about it.

11

u/jackherselman 13d ago

This is definitely the kinda guy who would fight you and then forget the next morning

Dude 100% should have recieved a much more serious charge here. That extendable baton is either a restricted or prohibited weapon used in a crime... That's supposed to carry some serious weight, but instead he gets charged with the same thing 16 year olds get charged with for spray painting a sign.

My mom has had to pull a gun on someone twice, once during road rage incident and once when someone was trying to break into our house and my dad wasn’t home.

I was a baby In the road rage one and was actively in the car. this man got out of his car and came at her car w/ a baseball bat. He hit the hood a couple times and then came to smash the window. She’s a Texas woman and in the army so she had a gun.

When she told me this story (when I first started driving) she was like “well i had to protect you, and I’d do It again”

Edit: neither man is dead! Sorry left out that little bit. The car incident ended in my mom hold this man at gun point till cops came while he yelled all sorts of profanities and spit at her

It’s impossible to know what to do in the situation – because we have no context for what preceded this, nor where it was. Some might say you would be justified in drawing a gun and firing on this person. Others might say what the driver did was perfectly reasonable and right.

240

u/3_quarterling_rogue 13d ago edited 13d ago

So, I’ve carried a gun virtually every day for the last five years, and at least with the context that we have here, this is not a situation that I think would warrant deadly force. The best and easiest way to resolve this situation is to drive away. If this person followed him and kept confronting him? Maybe that’s different. But a dude walks over to my car with a big rod? I’m just noping the heck out of there.

Edit to add: Yes, I know about Stand Your Ground states, I live in one. If I lived somewhere where the law was that someone paid me $500 every time I shot someone else, I’d still just drive away.

74

u/No-Dragonfly8326 13d ago

Dude walks up to my car with his big rod out and I will most certainly drive away.

21

u/3_quarterling_rogue 13d ago

If this dude wants to rock out with his rod out, good for him. I’m gunna drive away.

I’m gonna sound like a cunt for asking this. But I’ll take the risk. What’s with the “so” at the start of your comment? I see it a lot here. It kind of bugs me as unnecessary but maybe it’s because I don’t know the reason.

17

u/3_quarterling_rogue 13d ago

I laud your bravery, I’m a pedantic son of a bitch and even I wouldn’t ask this hahaha.

I think that adding “So” at the front is used in an informal way to as a way to prelude that you’re going to introduce new information, maybe especially if no one asked for it.

Is it strictly necessary? No, it definitely isn’t. I certainly wouldn’t put that in a paper I was writing. But of all the reasons to criticize people’s informal writing, there’s too many more egregious grammar sins I think are worth correcting before this one.

Not that I’m saying you’re wrong to be bothered by it, I totally get it. It’s just not the hill I’d want to die on, ya feel?

I'd say that guy handled it perfectly. Didn't escalate the situation in the moment, remained calm, got the guys identifying information including liscence Plate number, presumably filed a police report, and put it on social media for the world to see.

This is a textbook example of exactly what to do.

11

u/grarghll 13d ago

I disagree, the biggest mistake is staying in the encounter at all. Unless leaving would directly put someone else at harm, you have nothing to gain by sticking around.

Didn't escalate the situation in the moment

Telling them what they're doing is illegal is absolutely escalation. What's the expected outcome? "Oh, you're right, this is illegal! I'll go put this back, then." There is no good outcome, it's just an attempt to assert dominance over a situation by establishing yourself as legally in the right, which is not going to deter someone who's already shown disregard for the law. It's only going to piss them off more.

The correct thing to do is to tuck your tail and safely get out of the situation. Remember as much as you can and resolve it all afterward when you're not still in arm's reach of the guy with a weapon.
